HC Orders Quick Decisions in “Marriage During Iddat” Case Appeals

The Islamabad High Court (IHC) has instructed that the appeal in the “marriage during Iddat” case be resolved within a month, and the Session Court must decide on the suspension of the sentence within 10 days.

Justice Mian Gul Hassan Aurangzeb from the IHC heard the appeals from PTI founder Imran Khan and Bushra Bibi regarding their marriage during the Iddat period.

The court specifically directed the Session Court to make a decision on Bushra Bibi’s request to suspend the sentence within 10 days.

During the hearing, lawyer Salman Akram Raja expressed surprise at the sudden transfer of the case. He pointed out that the Session Judge originally heard the case but was now moved to an Additional Session Judge. He questioned the reason behind this transfer.

Salman Akram Raja emphasized that their main request was for Session Judge Shah Rukh Arjumand to announce the reserved decision.

Alternatively, he suggested that the High Court should take up the appeal and make a decision. As a third option, he proposed transferring the appeal to the Session Judge West, urging for a swift decision on the appeal, similar to the quick trial.

Khawar Maneka’s lawyer, Raja Rizwan Abbasi, argued that his client had previously objected to the judge, but the request was dismissed.

When the objection was raised again, the Session Judge referred the matter to the High Court, which then assigned the case to the Additional Session Judge West on administrative grounds. Abbasi stated that this administrative order could not be challenged.

He opposed moving the appeal from the Additional Session Judge back to the Session Judge.

After considering arguments from both sides, the court ordered that the appeal be decided within a month and Bushra Bibi’s request for suspension of the sentence be addressed within 10 days.

Justice Mian Gul Hassan Aurangzeb instructed Additional Session Judge Afzal Majoka to make both decisions within the specified timeframe.

It should be noted that Imran Khan had asked for the Session Judge to announce the reserved decision or for the High Court to hear the appeal itself. Bushra Bibi requested that the Session Court address her pending request for suspension of the sentence
